Terms and Conditions of Service
Please read this document carefully. This document is a legally binding agreement between you (the “Customer”) and Trash Panda (the “Company”).
By ordering roll-off dumpster or portable toilet services from the Company, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Services Provided
The Company agrees to provide roll-off dumpster rental and/or portable toilet rental services (the “Equipment”) at a location specified by the Customer (the “Site”). This includes delivering the Equipment and picking it up at the end of the rental period.
2. Customer Responsibilities
A. Prohibited Materials:
The Customer is strictly prohibited from placing any of the following materials into the dumpster:
- Hazardous Waste (including asbestos, solvents, etc.)
- Chemicals (solvents, cleaners, pool chemicals)
- Wet Paint, Oils, Fuels, or other Liquids
- Tires
- Batteries (of any kind)
- Appliances with Freon (refrigerators, AC units)
- Electronics (e-waste)
The Customer is responsible for all fines, fees, and costs associated with the improper disposal of prohibited materials. A “Contamination Fee” will be charged to the Customer if any prohibited items are found in the dumpster.
B. Loading Level:
The Customer agrees not to fill the dumpster higher than the top rail (“level-load”). All materials must be inside the bin. Overfilled dumpsters are a safety hazard and illegal to transport. The Company reserves the right to:
- Charge an “Overfill Fee.”
- Require the Customer to unload the excess material before pick-up.
- Leave the dumpster on-site, and a “Trip Fee” will be charged.
C. Weight Limits:
Each dumpster size has a specific weight limit. The Customer agrees to pay an “Overweight Fee” for every ton over the included limit. Do not load dumpsters with excessive amounts of heavy materials like concrete, dirt, or rock without prior approval.
D. Equipment Care:
The Customer is responsible for the Equipment while it is on their Site. The Customer agrees not to:
- Move the dumpster from its placed location.
- Light fires in the dumpster.
- Allow any damage, graffiti, or theft to occur.
The Customer will be billed for the full cost of repair or replacement for any damage to the Equipment (excluding normal wear and tear).
3. Access and Property Damage
A. Site Access:
The Customer must provide clear, safe, and unobstructed access for the Company’s trucks and drivers to deliver and pick up the Equipment. A “Trip Fee” will be charged if the Equipment cannot be dropped or picked up due to poor access.
B. Property Damage Waiver:
The Customer acknowledges that the delivery of a heavy roll-off dumpster and truck can be risky to property. The Company will take precautions, such as placing wooden boards under the dumpster, to protect the Customer’s driveway.
However, the Customer accepts all responsibility for any damage to driveways, curbs, lawns, fences, or other surfaces. Trash Panda is not liable for any damage resulting from the weight of our trucks and Equipment or the placement of the dumpster on the Customer’s property.
4. Permits and Legal Compliance
The Customer is solely responsible for determining if a permit is required for the placement of the Equipment.
If the dumpster is placed on private property (like a driveway), a permit is typically not required. If the dumpster must be placed on a public street, sidewalk, or right-of-way, the Customer is responsible for obtaining and paying for all necessary permits from the City of Carson City, Reno, or any other municipality.
Trash Panda is not responsible for any fines, fees, or penalties related to a lack of permits
5. Payment, Fees, and Cancellation
A. Payment:
Payment for the rental is due at the time of ordering. The Customer authorizes the Company to charge the credit card on file for the rental and for any additional fees incurred, including (but not limited to):
- Overweight Fees
- Contamination Fees
- Overfill Fees
- Trip Fees
- Daily rental fees for keeping the dumpster past the agreed-upon period
- Damage or replacement costs
B. Rental Period:
The standard rental period (7 days) will be stated on the order. The Customer agrees to pay a daily fee for each day the Equipment is kept beyond this period.
C. Cancellation:
Cancellations must be made at least 24 hours before the scheduled delivery time. A “Trip Fee” will be charged if a cancellation is made after our driver has been dispatched.
6. Indemnification
The Customer agrees to indemnify, defend, and hold harmless Trash Panda, its owners, and its employees from any and all claims, damages, losses, and liabilities (including legal fees) arising from the Customer’s use, or possession of the Equipment.
7. Acceptance of Terms
By ordering services from Trash Panda, the Customer acknowledges they have read, understood, and agree to be bound by these Terms and Conditions.
